๐ Building Permit
- Adopted code
- West Virginia State Building Code (87 CSR 4), 2018 IBC + 2018 IFC with WV amendments; 2020 NEC; 2015 IECC. Effective Aug 1, 2022.
- Permit threshold
- Per 2018 IBC ยง105.2, storage racks over 8 ft 11 in (2,743 mm) in height require a building permit. Lower racks are exempt.
- Issuing authority
- Local jurisdictions where adopted (Charleston, Huntington, Morgantown, South Charleston, etc.). WV State Fire Commission promulgates the code; local enforcement is required only in jurisdictions that have adopted. Rural counties may have no AHJ.
- Typical fee range
- Charleston: Plan Review Fee = 0.0075 ร total cost of construction for commercial permits over $50,000; building permit fee scales by valuation. For a $40K rack install, expect roughly $300โ$800 total. Huntington: $20 application fee plus a permit fee based on labor + materials cost.
- Typical review time
- Not published by Charleston or Huntington in official materials. Anecdotally 2โ4 weeks for commercial in Charleston.
๐ Seismic Requirements
- Seismic Design Category
- B for typical Risk Category II warehouse occupancies on Site Class D across most of WV. Eastern WV counties (Pendleton, Hardy, Grant, Hampshire, Mineral) sit near the Giles County, VA seismic zone and can reach SDC C depending on Site Class and Risk Category
- Sds range
- ASCE 7-22, Site Class D default: Charleston ~0.13โ0.16g; Huntington ~0.14โ0.17g; Morgantown ~0.14โ0.17g; eastern WV (Petersburg, Franklin near Giles zone) ~0.18โ0.25g.
- Anchoring & bracing
- 2018 IBC ยง2209 references RMI/ANSI MH16.1 for steel storage rack design. In SDC B (most of WV), seismic detailing is required but reduced; in SDC C (eastern WV pockets), full MH16.1 seismic provisions apply with R factor reductions and bracing detailing.
๐ฅ Fire Marshal
- When fire review is triggered
- WV adopts 2018 IFC; Chapter 32 (High-Piled Combustible Storage) triggers at > 500 sq ft of high-piled storage (12 ft+ general, 6 ft+ for high-hazard commodities). Plans and a storage permit must be submitted to the AHJ โ locally the fire marshal, with WV State Fire Marshal oversight.
๐๏ธ Engineer Stamp
- When PE-stamped drawings are required
- Yes. WV Code ยง30-13-13 and ยง30-13-16 require a WV-registered PE seal/signature on engineered designs offered to the public; the seal must read "Registered Professional Engineer, State of West Virginia" and the work must be under the PE's direct control.
โ ๏ธ Local Quirks
Things that surprise out-of-state buyers in West Virginia.
- Energy-corridor warehousing (coal, natural gas, oilfield services) in north-central and southern WV.
- Kanawha Valley chemical-industry warehouses (Charleston/South Charleston/Institute) often trigger hazmat overlays beyond Ch. 32.
- Rural enforcement is thin โ many counties have no building department, in which case only the state fire marshal effectively has jurisdiction over commercial racking.
- Eastern panhandle/Allegheny counties feel the Giles County, VA seismic zone โ more conservative anchor design appropriate.
- WV is an unusual case: 8'-11" permit threshold per 2018 IBC (vs. the 5'-9" used in most states). Verify with AHJ.
