📋 Building Permit

Adopted code
2021 Virginia Uniform Statewide Building Code (USBC), administered by DHCD as 13VAC5-63. Administrative provisions took effect January 18, 2024; technical provisions of the 2021 USBC became mandatory January 18, 2025. The 2021 VCC references ASCE 7-22 for structural loads.
Permit threshold
Virginia reorganizes IBC §105.2 as USBC §108.2 (Work exempt from permit). The 16 listed exemptions in 13VAC5-63-80 cover small sheds, fences, swimming pools, signs, flagpoles, and ordinary repairs — but DO NOT include the IBC's standard "movable racks not over 5'-9"" language. Typical practice: fixed/anchored industrial racks over 5'-9" trigger a permit, but operators should confirm locally because Virginia struck the standard IBC carve-out.
Issuing authority
Local building department (city or county) issues permits and performs inspections. DHCD's State Building Codes Office (SBCO) provides statewide oversight, code interpretation, and training — it does not issue local permits.

Richmond commercial alterations: $265 minimum + $0.28/sq ft; new commercial construction: $390 minimum + $0.30/sq ft, plus a 2% state surcharge. Fairfax County assesses Fire Marshal review at $156/hour and re-inspections at $108. Loudoun fees scale with construction valuation. Expect $500–$3,000 for a typical rack install permit depending on declared value.
Typical review time
Fairfax County LDS performs application completeness review within 2 business days, then commercial technical review (Fast Track and Non-Fast Track) follows. Loudoun County completes intake within 10 business days, then routes to technical review. Richmond DPCD timelines vary; commercial reviews commonly run 3–6 weeks.

🌐 Seismic Requirements

Anchoring & bracing
ANSI MH16.1-2021 governs rack design in Virginia by reference through IBC Chapter 22/Chapter 16. SDC A/B installations still require designed anchorage per ASCE 7-22 §13.

When fire review is triggered
The 2021 Virginia Statewide Fire Prevention Code (13VAC5-52), effective January 18, 2024, adopts IFC Chapter 32 with VA amendments. High-piled combustible storage triggers when top of storage exceeds 12 ft for ordinary commodities or 6 ft for high-hazard commodities (Class IV / high-hazard). Plans must be submitted to the building official before use; sprinklers per NFPA 13 by commodity class and pile height. SFM is administered through DHCD/VDFP.

When PE-stamped drawings are required
Yes for structural plans submitted for permit. VA Code §54.1-400 et seq. and 18VAC10-20 (APELSCIDLA Board) require plans, calculations, and specifications to bear the seal, signature, and date of a Virginia-licensed PE (or RA where applicable). Every final sheet must be sealed. Digital seals permitted if uniquely tied to the licensee. Out-of-state PEs must hold a Virginia license — comity is available but not automatic.

  • Hampton Roads (Virginia Beach, Norfolk, Chesapeake, Eastern Shore) sits in an ASCE 7-22 wind-borne debris region with 120–130 mph design wind speeds. Rarely affects interior racking but can affect anchorage to slab-on-grade in tilt-up warehouses near the coast.
  • Some rural Southside and Southwest counties contract with DHCD's State Building Code Technical Review Board for minimal in-house enforcement — expect variable turnaround.
  • The 2011 M5.8 Mineral earthquake is the canonical reference for VA seismic risk — projects in Louisa County and the Central VA Seismic Zone face more careful structural scrutiny than elsewhere in VA.
