๐Ÿ“‹ Building Permit

Adopted code
Historically no statewide commercial building code, but Public Act 103-0510 amended the Capital Development Board Act to require statewide baseline codes (IBC, IEBC, IRC) effective January 1, 2025, with local compliance documentation due to CDB by June 1, 2025. Local AHJs still adopt and enforce the chosen edition (commonly 2021 IBC). Chicago is exempt and runs the separate Chicago Construction Codes (2019 Chicago Building Code with April 2022 Supplement, IBC-aligned via the 2019โ€“2022 modernization).
Permit threshold
Under IBC ยง105.2, nonfixed/movable racks not over 5'-9" are exempt in jurisdictions following IBC. Chicago raises that bar significantly: CCC ยง14A-4-402.1 exempts nonfixed/movable racks not over 7 ft. Anything taller (or fixed) requires a permit.
Issuing authority
Local municipal building department in incorporated places. Cook County Department of Building and Zoning handles unincorporated Cook County. Chicago Department of Buildings handles inside Chicago city limits.
Typical fee range
Chicago uses a formula-based schedule (Construction Factor ร— Scope-of-Review Factor ร— area) with a $302 minimum plus separate zoning and trade-permit fees. Cook County and most IL suburbs are valuation-based; a non-residential e-permit application requires a $500 deposit applied to the final fee.
Typical review time
Chicago DOB's published target for Standard Plan Review is 53 days (~7โ€“8 weeks). Commercial racking projects typically land in the 7โ€“12 week range depending on disciplines triggered. Suburbs are typically faster.

๐ŸŒ Seismic Requirements

Typical site values: Chicago Sds ~0.10โ€“0.15g; Springfield ~0.20โ€“0.30g; Cairo / far-southern IL ~0.6โ€“1.0+ g (Site Class D default). Always verify per-site at the ASCE Hazard Tool โ€” these are typical ranges, not design values.
Anchoring & bracing
ANSI MH16.1-2023 requires site-specific seismic design including SDC, soil class, and slab thickness. In SDC A/B (most of IL), standard base plates with code-compliant anchors are typically adequate. In SDC C and especially D (southern IL), MH16.1 ยง2.6.6 mandates seismic separation from building columns, heavier base plates, and stricter anchor detailing.

When fire review is triggered
Illinois OSFM enforces the 2015 NFPA 101 Life Safety Code statewide via 41 Ill. Adm. Code 100; locally adopted codes apply concurrently. Local fire departments perform day-to-day enforcement. IFC Chapter 32 triggers high-piled storage permits and design requirements when top-of-storage exceeds 12 ft (6 ft for high-hazard commodities) AND the storage area exceeds 500 sq ft.

When PE-stamped drawings are required
Yes statewide. Illinois Professional Engineering Practice Act of 1989 (225 ILCS 325) ยง15(c) forbids any public entity from accepting technical submissions requiring PE involvement that do not bear the seal and signature of an Illinois-licensed PE. Structural drawings for permitted rack installations must be IL-PE stamped. IDFPR licenses PEs (CORE system launched Oct 2024).

โš ๏ธ Local Quirks

Things that surprise out-of-state buyers in Illinois.

  • No uniform code until 2025. Pre-PA 103-0510 enforcement varied widely. Rural counties may still have light enforcement during the rollout.
  • Chicago is its own world: separate 2019 CCC + April 2022 Supplement, separate e-portal, separate fee and review tracks. Use a Chicago-specialist consultant, not a generic IL one.
  • New Madrid risk: southern IL counties carry real seismic detailing burden that out-of-state engineers consistently underestimate.
  • OSFM high-piled trigger: IFC ยง3201 top-of-storage 12 ft / 500 sq ft. State fire marshal sets the floor; local fire departments enforce it.
  • Chicago Self-Cert: an IL-licensed architect/SE can self-certify eligible smaller projects, but large industrial racking typically routes through Standard Plan Review.
  • Cook County โ‰  Chicago: unincorporated Cook County uses its own Building Code under the Department of Building and Zoning, not the Chicago Construction Codes.
