๐Ÿ“‹ Building Permit

Adopted code
Wisconsin Commercial Building Code, Wis. Admin. Code chs. SPS 361-366, based on 2021 IBC (with WI amendments). Also adopts 2021 IECC, IMC, IFGC, IEBC.
Permit threshold
Per SPS 361.30, DSPS plan review is mandatory for commercial/industrial/public buildings 25,000 cubic feet or larger, and any size school, high-hazard, or 3-unit+ residential. IBC ยง105.2 with WI amendments governs work that does not require a permit. Storage racks themselves are typically reviewed when they impart loads to the building or trigger high-piled combustible storage thresholds.
Issuing authority
DSPS Division of Industry Services performs DIRECT state plan review on most commercial buildings โ€” this is mandatory and runs in parallel with any local AHJ enforcement. Local municipalities (Milwaukee DNS, Madison Building Inspection, Green Bay, Kenosha) also issue construction permits and inspect.
Typical fee range
DSPS: $100 plan-entry fee per submittal, plus plan review + inspection fees per Table 302.31-1/-2 on form SBD-118. Milwaukee: Plan-exam and permit fees per MCO ยง200-33 and Ch. 81, computed on square footage.
Typical review time
DSPS publishes monthly submission/turnaround data; no fixed statutory clock for commercial. Applicants must respond to DSPS information requests within 5 business days or the plan is subject to denial plus a $60 fee.

๐ŸŒ Seismic Requirements

Seismic Design Category
A across essentially all of Wisconsin for standard occupancies on Site Class C/D
Sds range
Milwaukee and Madison both fall in the very-low range โ€” typical mapped Sds well under 0.167g, keeping sites in SDC A.
Anchoring & bracing
ANSI MH16.1-2021 (RMI) governs. In SDC A, seismic loads are nominal and wind/impact typically control, but MH16.1 stability and base-plate checks still apply.

๐Ÿ”ฅ Fire Marshal

When fire review is triggered
DSPS Division of Industry Services / Fire Prevention program IS the State Fire Marshal function โ€” fire-protection review is bundled into DSPS commercial plan review (sprinklers, alarms, high-piled storage). High-piled combustible storage > 12 ft, ESFR systems, and in-rack sprinkler design flag fire review.

๐Ÿ›๏ธ Engineer Stamp

When PE-stamped drawings are required
Yes. Wis. Stat. ch. 443 governs PE practice; ยง443.17 makes it unlawful to seal documents not prepared by or under direct control of the licensee. WI-licensed PE seal required on rack structural calculations when plan review applies.

โš ๏ธ Local Quirks

Things that surprise out-of-state buyers in Wisconsin.

  • DSPS mandatory state layer โ€” like Indiana, WI runs a state-level plan-review process on top of local permits; do NOT skip it because the city issued a permit.
  • Milwaukee โ€” port/harbor industrial corridor; DNS is active and enforces MCO Chs. 81 + 200 on top of DSPS.
  • Green Bay โ€” paper/packaging warehouse cluster; cold-storage and tall-rack ESFR sites common, expect fire review.
  • Cold-storage dairy / freezer warehouses pervasive; cold-formed steel rack performance at low temps and frost-heaved slabs are recurring engineering issues.
  • Rural/small towns โ€” many have no local building department; DSPS state review becomes the sole structural/fire AHJ.
