📋 Building Permit

Adopted code
No statewide commercial building code — adoption is delegated to municipalities and counties. All five major metros are on the 2021 I-Codes with local amendments: Houston (eff. Jan 1, 2024), Dallas (eff. May 12, 2023), Austin (June 3, 2021), San Antonio (eff. Feb 1, 2023), Fort Worth (eff. April 1, 2022). Note: Houston DOES publish IBC amendments — contrary to a common belief that it's unamended.
Permit threshold
IBC §105.2 exempts movable racks not over 5'-9" tall in jurisdictions that have adopted the IBC. Major TX cities follow this baseline. Racks taller than 5'-9" generally require a permit; fire department review applies separately above 12 ft.
Issuing authority
Purely local — no state-level rack permit. Inside city limits, the city building department is the AHJ (Houston Permitting Center, Dallas Building Inspection, Austin DSD, San Antonio DSD, Fort Worth Development Services). Large urban counties (Harris, Tarrant, Bexar) enforce IFC/IBC in unincorporated areas; many rural counties have no commercial building code enforcement at all.
Typical fee range
$500–$5,000 for a permitted rack install, depending on city, valuation, and review depth. All major TX cities use valuation-based formulas. Houston adds plan review at 25% of permit fee; Dallas adds $0.46/sqft or $577 min plan review; Austin runs plan review around 65% of permit fee. Pull exact figures from each city's fee calculator.
Typical review time
Houston commercial plan review is roughly 20–30 business days for the initial cycle; total time-to-permit including corrections runs 8–16 weeks. Austin's published target is 7–25 business days per cycle. Suburbs are typically faster than the central cities.

Sds range
Site-specific. Typical default-site values: Houston, Dallas, Austin, San Antonio all well under 0.25g (SDC A–B territory); El Paso ≈ 0.30–0.50g (SDC B–C, Site Class D). Pull per-address values from the ASCE 7-22 Hazard Tool. DFW and the Permian Basin have elevated induced (injection-related) seismicity tracked by USGS but it doesn't generally elevate site SDC for typical Risk Category II buildings.
Anchoring & bracing
ANSI MH16.1-2021 governs and references ASCE/SEI 7 for seismic loading. SDC A racks receive minimum detailing — anchorage to resist lateral forces, but no special detailing. SDC B/C racks require code-compliant base anchorage and seismic separation per MH16.1; specific seismic response coefficients per MH16.1 §15 apply. Most TX warehouses fall into the lowest seismic-detailing tier, but slab anchorage is still required for any permitted rack.

🔥 Fire Marshal

When fire review is triggered
Local — the Texas State Fire Marshal's Office (under TDI) has jurisdiction over state-owned buildings, public/charter schools, and licensed daycares, NOT typical commercial warehouses. Commercial rack fire review runs through the city's adopted IFC. IFC 2021 Chapter 32 triggers fire department plan review when top of storage exceeds 12 ft for ordinary commodities or 6 ft for high-hazard goods (Group A plastics, rubber tires, flammable liquids, idle pallets).

🏛️ Engineer Stamp

When PE-stamped drawings are required
Yes for any rack drawings submitted for permit. The Texas Engineering Practice Act (Tex. Occ. Code Ch. 1001) requires a TX-licensed PE seal on engineering plans. §1001.401 prohibits building officials from accepting engineering plans without one. Narrow exemptions exist for some residential and small commercial; commercial rack does not qualify.

⚠️ Local Quirks

Things that surprise out-of-state buyers in Texas.

  • No statewide commercial building code. Every jurisdiction sets its own, and rural unincorporated counties may have zero enforcement (e.g. Jasper County has no commercial building code program).
  • Houston has no zoning ordinance (voters rejected it in 1948, 1962, and 1993) but does enforce a building code via the Houston Permitting Center.
  • Dallas amends 2021 IBC heavily (EV-ready and solar-ready provisions). Austin amends with a sustainability overlay. Houston publishes amendments despite industry myth that it's "unamended."
  • TWIA's 14 first-tier coastal counties (Galveston, Aransas, Cameron, Nueces, etc.) trigger separate windstorm certification for the building envelope. Interior rack is not typically reviewed for windstorm.
  • Texas heat is a building envelope/HVAC concern more than a rack-steel concern — rack capacity at normal warehouse temperatures is not affected.
