Adopted code
New Mexico Commercial Building Code (NMCBC) โ€” 2018 IBC with NM amendments, codified at 14.7.2 NMAC. Adopted statewide through CID. (Note: a 2021 NMCBC has been drafted/approved but the 2018-based NMCBC remains the operative cycle in CID's current rule listing โ€” verify effective date.)
Permit threshold
IBC ยง105.2 governs. Storage racks over 5'-9" require a building permit; under that height they may be exempt as "non-fixed and movable fixtures." Per IFC ยง105.5 / ยง3208, high-piled combustible storage permit also required when storage exceeds 500 sq ft.
Issuing authority
NM CID does direct plan review and permitting statewide UNLESS the local jurisdiction is certified. Albuquerque and Santa Fe are certified for commercial; Las Cruces also operates its own building safety office.
Typical fee range
CID statutory schedule: $3.00/$1,000 valuation up to $15,000, then $1.00/$1,000 above. ABQ uses IBC Table 1-A with a 0.67 regional modifier; plan check = 65% of permit fee, due at submittal. Santa Fe: $40 admin + valuation tier.
Typical review time
Las Cruces publishes 0โ€“8 business days for commercial depending on valuation; projects โ‰ฅ $1M require pre-submittal meeting. CID and ABQ do not publish a guaranteed SLA โ€” plan on 2โ€“4 weeks for commercial.

Anchoring & bracing
RMI/ANSI MH16.1-2021 applies; SDC B/C/D triggers full seismic detailing including base-plate anchorage, frame bracing, and ฮฉโ‚€ overstrength on anchors per ASCE 7-22 ยง13.

When fire review is triggered
NM State Fire Marshal (under RLD) enforces 2021 NM Fire Code (IFC with amendments) per 10.25.5 NMAC. Operational + construction permit for high-piled storage > 500 sq ft; full submittal required per IFC ยง3201.3 (commodity class, aisle widths, sprinkler design, smoke removal).

  • Four Corners region tribal lands (Navajo Nation) are outside CID jurisdiction โ€” separate tribal permitting.
  • Many rural counties have no local building department; CID is the sole AHJ.
  • Las Cruces I-10 / Santa Teresa border-logistics corridor sees heavy DC buildout; pre-submittal meeting mandatory โ‰ฅ $1M.
