📋 Building Permit

Adopted code
Two codes, one state. Statewide Uniform Code = 2020 NYS code books (BCNYS, FCNYS, etc.) based on the 2018 ICC I-Codes, effective May 12, 2020. NYC uses the 2022 NYC Construction Codes (Building, Mechanical, Fuel Gas, Plumbing) based on the 2015 IBC family with extensive NYC amendments, effective Nov. 7, 2022.
Permit threshold
Outside NYC: IBC §105.2 exempts movable racks not over 5'-9". Inside NYC: NYC Admin Code §28-105.4 lists permit exemptions but has no rack-specific carve-out, so industrial rack installations in NYC effectively always require DOB filing (typically as an Alteration).
Issuing authority
Outside NYC: the local building department of the city/town/village (e.g. Buffalo, Rochester, Syracuse, Albany) issues permits under NYS DOS oversight. Inside NYC: the Department of Buildings (DOB) issues all permits across the five boroughs. Completely different application and inspection processes.
Typical fee range
NYC DOB uses the Schedule of Fees in NYC AC §28-112.2 (initial fee + per-square-foot or valuation surcharge). Typical industrial rack alteration filings run roughly $400–$2,500+ depending on scope. Upstate cities use valuation-based fees; commercial rack permits typically run $200–$1,500.
Typical review time
NYC is slow. DOB Alteration filings commonly take 1–3 months for Alt (formerly Alt-2) and 3–6 months for Alt-CO (formerly Alt-1), with each objection round adding 2–4 weeks. Upstate jurisdictions typically issue commercial rack permits in 4–8 weeks once a stamped submittal is complete.

Sds range
NYC Sds roughly 0.25–0.35g (higher with soft soils), Albany ~0.15–0.20g, Buffalo ~0.10–0.15g. Project-specific Sds must be pulled from the ASCE Hazard Tool for the actual address — these are typical ranges, not design values.
Anchoring & bracing
ANSI MH16.1-2021 (adopted by reference in IBC/NYS) requires racks be designed to ASCE 7-22 seismic loads, with anchor-bolt + base-plate detailing that scales with SDC. SDC D and higher trigger added rules including seismic separation between racks and building columns and overstrength anchorage. Most NY racks need standard cast-in-place or post-installed anchor bolts; NYC SDC C/D sites often require enhanced base plates and code-listed seismic anchors.

🔥 Fire Marshal

When fire review is triggered
NYS Fire Code Chapter 32 governs high-piled combustible storage — applies when top of storage exceeds 12 ft (or 6 ft for high-hazard commodities) and a permit per §105.6 is required. Statewide, local code enforcement officers (overseen by OFPC under NYS DHSES) handle review. In NYC, FDNY Bureau of Fire Prevention runs a separate high-piled storage permit ($210) for areas > 500 sq ft, with design documents reviewed by FDNY Fire Prevention Technology Management Unit.

🏛️ Engineer Stamp

When PE-stamped drawings are required
Yes statewide. NYS Education Law Article 145 §7209 requires every plan, specification, or report filed with a NY public official for construction or alteration to bear the seal and personal signature of a NYS-licensed PE (or architect). Building departments — statewide and NYC — cannot legally accept unstamped commercial rack drawings.

⚠️ Local Quirks

Things that surprise out-of-state buyers in New York.

  • NYC vs rest-of-state: two completely separate code books, fee schedules, and review processes. Plan for different consultants and filing timelines.
  • NYC ALT-CO / Alt filings: any rack work changing use, occupancy, egress, or building configuration may trigger an Alt-CO (formerly Alt-1) requiring a new Certificate of Occupancy. Smaller scopes file as standard Alt under DOB NOW.
  • FDNY review is independent of NYC DOB. High-piled storage routes through FDNY Bureau of Fire Prevention even if DOB has already approved the structural rack filing.
  • NYC Local Law 97: buildings > 25,000 sq ft (including Group S warehouses) face GHG emissions limits — not rack-specific but affects warehouse retrofit scope and cost.
  • NYS PE registration: NY has NO formal reciprocity/comity for engineers. Out-of-state PEs must apply for endorsement (often via NCEES Record) or obtain a limited temporary permit. Out-of-state seals alone are not acceptable.
  • Long Island (Nassau, Suffolk) and Westchester impose town/village-level requirements (surveys, drainage, parking) layered on top of state code; county jurisdiction applies for work on county roads.
