Adopted code
North Dakota State Building Code based on the 2021 I-Codes (IBC/IFC/IMC/IFGC) with state amendments. Statewide adoption is mandatory for state-owned/leased buildings, but for private projects the DCS does not enforce โ€” local cities/counties choose to adopt and enforce. The 2024 I-Codes update is scheduled for adoption effective January 1, 2026 (building) and July 1, 2026 (fire).
Permit threshold
Storage racks over 5 ft 9 in (1,753 mm) in height require a permit per IBC ยง105.2 work-exempt list; racks below that height are exempt. ND has not amended this provision.
Issuing authority
The local building official in jurisdictions that have adopted the code (Fargo, Bismarck, Grand Forks, West Fargo, Minot, Dickinson, Williston). Many rural counties have no building department โ€” rack work proceeds without a building permit in those areas, but the State Fire Marshal still has fire-code jurisdiction.
Typical fee range
Fargo uses a valuation-based fee schedule with plan review at 20% of the building permit fee, $50 minimum. For a typical $25Kโ€“$75K rack install, expect roughly $400โ€“$1,200 total (permit + plan review). Bismarck publishes its own valuation table; comparable range.
Typical review time
Not formally published by Fargo or Bismarck. Verbal benchmarks from those offices typically run 2โ€“4 weeks for commercial plan review.

A across essentially all of North Dakota under ASCE 7-22 / IBC 2021. The state has the lowest seismicity in the continental US

Typical Sds values across ND run roughly 0.02gโ€“0.06g (Site Class D default). Far below the SDC B threshold of 0.167g.
Anchoring & bracing
ANSI/RMI MH16.1-2021 governs steel storage rack design. In SDC A, seismic detailing requirements are minimal; ASCE 7-22 ยง11.7 only requires lateral force per ยง1.4.3 (5% of operating weight). MH16.1 still requires the rated capacity placard and configuration drawings.

When fire review is triggered
The ND State Fire Marshal (under the Insurance Department) administers the fire code statewide via NDAC 45-18-01. IFC Chapter 32 (High-Piled Combustible Storage) triggers fire-marshal review when storage exceeds 12 ft (or 6 ft for high-hazard commodities) and the high-piled area exceeds 500 sq ft.

When PE-stamped drawings are required
Yes for engineered drawings. NDCC Ch. 43-19.1 and NDAC 28-02.1-08 require any final engineering drawings, specifications, maps, plats, reports, or other documents prepared by a person required to be registered to be signed, dated, and sealed by a ND-licensed PE. Out-of-state PEs must obtain ND comity licensure.

  • Bakken oil/gas region (Williston, Watford City, Dickinson) drives heavy industrial rack demand โ€” pipe storage, parts/MRO warehouses, frac sand.
  • Cold-weather steel: ASTM A1085/A500 with consideration for low-temp brittle fracture in unheated facilities.
  • Agriculture warehouses (Red River Valley) often fall outside enforced jurisdictions.
  • Population sparsity means many rural counties have no plan reviewer โ€” fire marshal becomes the de facto AHJ via IFC Ch. 32.
  • Lowest seismic risk in the lower 48 โ€” but anchorage still required per MH16.1 minimums.
